GeoPharma to pay more than $136,700 in back wages to 82 employees in Largo, Fla., following US Labor Department investigation


Company also fined $15,300 for repeat violations of Fair Labor Standards Act

LARGO, Fla. -- Following a U.S. Department of Labor Wage and Hour Division investigation of GeoPharma Inc. that found 82 employers were not paid the minimum wage and proper overtime compensation as required by the Fair Labor Standards Act, the company has agreed to pay $136,789 in back wages to workers plus $15,300 in civil money penalties to the government.

The company manufactures dietary supplements and pharmaceuticals in Largo. The affected employees worked in GeoPharma's production, inventory control and shipping areas.

"The Labor Department is working hard to ensure that employees are properly paid according to the law," said James Schmidt, the Wage and Hour Division's district director in Tampa. "We will not allow companies to profit by not paying their workers and ignoring FLSA rules on minimum wage and overtime compensation."

Following a previous Wage and Hour Division investigation, GeoPharma was held liable for more than $1.36 million in back wages for failing to compensate 187 employees for all hours worked from December 2009 through April 2010.

This latest investigation determined that GeoPharma failed to meet payroll for five intermittent pay periods between July and October 2010, resulting in the FLSA violations. In addition to agreeing to pay all back wages as well as the civil money penalties assessed, the company has agreed to comply with the law in the future.

The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers are required to keep accurate records of all hours worked by covered employees.
