Fairmont, W.Va., company agrees to pay nearly $30,000 in back wages after US Labor Department investigation
FAIRMONT, W.Va. -- Grand China Buffet and Grill has agreed to pay $29,054 in back wages to 35 workers after a U.S. Labor Department’s Wage and Hour Division investigation identified violations of the Fair Labor Standards Act (FLSA) at its Fairmont and Clarksburg, W.Va., establishments.
The investigation found that the company did not pay employees at least the federal minimum wage and paid them straight time for hours worked in excess of 40 per week. They also did not maintain proper payroll records.
“It is important for employers to fully understand their obligations under the law to ensure all employees are compensated properly,” said John DuMont, director of the Wage and Hour Division’s Pittsburgh District Office.
The Fairmont establishment opened in February 2009 and employs approximately 14 employees, and the Clarksburg establishment opened in January 2003 and employs approximately 16 workers.
The FLSA requires that covered employees be paid at least the federal minimum wage as well as one and one-half times their regular rates of pay for hours worked over 40 per week. Earnings may be determined on a piece-rate, hourly, salary, commission or some other basis, but in all such cases the employee must receive the federal minimum wage for all hours worked. Additionally, the law requires that accurate records of employees’ wages, hours and other conditions of employment be maintained. The current federal minimum wage for covered, nonexempt employees is $7.25 per hour.
