US Department of Labor recovers more than $280,000 in overtime back wages for more than 1,000 employees of New Liberty Hospital in Missouri


LIBERTY, Mo. -- The U.S. Department of Labor’s Wage and Hour Division has recovered $282,166 in overtime back wages for 1,032 nursing, security and maintenance employees of New Liberty Hospital in Liberty for violations of the Fair Labor Standards Act (FLSA).

An investigation by the department concluded that the hospital’s timekeeping system did not count the time worked either before or after a scheduled shift unless it amounted to a full 12 minutes. Additionally, investigators found that the hospital’s security department automatically deducted 30 minutes for lunches whether or not the employees were able to take them.

“When computing overtime pay, employers are required to include compensable time worked both at the beginning and at the conclusion of the workday,” said James Koren, the Wage and Hour Division’s district director in Kansas City, Kan. “The department’s Wage and Hour Division will continue to conduct rigorous investigations to help ensure workers receive the wages to which they’re entitled.”

The FLSA requires that covered, nonexempt employees to be paid at least the federal minimum wage of $7.25 per hour for all hours worked, and time and one-half their regular rates of pay for hours worked beyond 40 in a week. Employers must also maintain accurate time and payroll records.
