U.S. Labor Department recovers more than $24,000 in back wages for employees of Omaha, Neb., restaurant
OMAHA, Neb. -- The U.S. Department of Labor has recovered $24,360 in back wages for seven employees of the Hong-Fa Corp. working at the company’s Golden Palace restaurant in Omaha, following an investigation conducted by the department’s Wage and Hour Division.
The Wage and Hour Division’s Des Moines, Iowa, district office conducted the investigation as part of an ongoing regional effort to increase Fair Labor Standards Act (FLSA) compliance in the restaurant industry.
The investigation found that the company violated the overtime provisions of the FLSA by not paying the employees time and one-half their regular rates for hours worked beyond 40 in a workweek.
“The Labor Department’s Wage and Hour Division is committed to protecting the rights of workers by ensuring they receive the wages they’re entitled to,” said Percella Maupins, the division’s district director in Des Moines.
The investigation further disclosed that the company was not properly maintaining time records for the employees. Hong-Fa cooperated fully and has since come into compliance, said Maupins.
The FLSA requires covered, nonexempt employees to be paid at least the federal minimum wage of $6.55 per hour for all hours worked, and time and one-half their regular rates of pay for hours worked beyond 40 in a week.
