ALAMOGORDO, N.M. -- The German Air Force Tactical Training Center located at Holloman Air Force Base in Alamogordo has paid $33,768 to eight current and former drivers following an investigation by the U.S. Department of Labor’s Wage and Hour Division that found violations of the overtime provisions of the Fair Labor Standards Act.
“The Labor Department wants to ensure that employees who put in an honest day’s work receive an honest day’s pay. This employer profited by paying workers less than they were legally due under the Fair Labor Standards Act,” said Cynthia Watson, the Wage and Hour Division’s regional administrator for the Southwest. “The FLSA provides protection not only to workers, but to employers by preventing their competitors from receiving an unfair advantage by dodging the law.”
An investigation by the division’s El Paso Area Office in Texas determined that employees received compensatory time off for hours worked over 40 in a week rather than pay at time and one-half their regular rates as required by the FLSA. Additionally, deductions were made from their pay for lunch breaks, even when employees worked through those periods.
The training center, which was established by the German Air Force in 1996 to provide advanced tactical training for air crews on the Tornado Fighter Bomber, has agreed to future compliance with the FLSA. Back wages owed have been paid in full.
The FLSA requires that covered, nonexempt employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Additionally, employers must maintain accurate time and payroll records.
