EULESS, Texas -- Advaitaa Technologies Inc. in Euless has paid $22,989 to former and current computer programmers and software engineers after an investigation by the U.S. Department of Labor’s Wage and Hour Division found that 24 employees were not properly paid in accordance with the H-1B provisions of the Immigration and Nationality Act.
“These employees were not fully compensated for hours worked as required by the H-1B program,” said Cynthia Watson, the Wage and Hour Division’s regional administrator in the Southwest. “These illegal practices will not be tolerated.”
An investigation by the division’s Dallas, Texas, office found that Advaitaa Technologies failed to meet the actual wage standard required by prevailing wage regulations. As a result, the company did not pay its employees the full salary required by law. The company, which provides technology solutions to various organizations in the metropolitan area, has agreed to future compliance. Back wages have been paid in full.
The H-1B visa program allows non-immigrant foreign workers in professional occupations, such as computer programmers, engineers, medical doctors and teachers, to enter the United States and work temporarily. By law, H-1B workers are to be paid the same wage rates and benefits as those paid to workers in the United States already doing the same jobs in the same geographic areas.
