AMARILLO, Texas -- The U.S. Department of Labor is seeking to recover $27,957 in back wages for four employees of Mesa Mail Service LLC, a contract hauler of mail for the U.S. Postal Service in and around Amarillo.
Mesa Mail Service has contracts with the U.S. Postal Service to haul mail in the Amarillo to towns in west Texas. Under the contracts, the company failed to pay its workers the prevailing wage plus health and welfare benefits as required by the Service Contract Act (SCA).
ďThe Department of Labor is committed to ensuring that all workers are paid the full wages and fringe benefits they are entitled to receive,Ē said Cynthia Watson, the Wage and Hour Divisionís regional administrator for the Southwest.
An investigation by the departmentís Wage and Hour Division in Albuquerque, N.M., found that Mesa Mail Service refused to pay the back wages. As a result, a complaint was filed with the departmentís Office of Administrative Law Judges for the collection of back wages and the debarment of Mesa Mail Service and its owners, as well as supervisors Richard Edwards, Mary Edwards and Mikael Freeman, from federal contracts.
The SCA covers contracts entered into by federal agencies where the principal purpose of the contract is to furnish services in the United States through the use of service employees. The SCA requires that every federal service contract in excess of $2,500 contains a wage determination reflecting wages and fringe benefits prevailing in the locality or contained in the collective bargaining agreement of the predecessor contractor.
