AUSTIN, Texas -- MT Supermarket in Austin has paid $186,624 in back wages to 34 cashiers, stockers, sackers, meat market and office managers after an investigation by the U.S. Department of Labor’s Wage and Hour Division found the workers had not been paid the proper minimum wages or overtime pay.
“This employer paid its employees on a cash basis without regard to any hours worked over 40 in a workweek,” said Cynthia Watson, the Wage and Hour Division’s regional administrator for the Southwest. “Some employees worked up to 67 hours during a workweek and were not paid overtime wages. This is unacceptable.”
The investigation by the Wage and Hour Division’s San Antonio district office found the employer had violated the minimum wage, overtime and record keeping provisions of the Fair Labor Standards Act (FLSA). Additionally, the company did not maintain the required recordkeeping.
The FLSA requires employers to pay covered, non-exempt employees the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records.
The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers must also maintain accurate time and payroll records.
