MEMPHIS, Tenn. -- Taylor Brown Gardens Healthcare LLC has agreed to pay $66,694 in back wages to 17 low-wage home healthcare employees and to correct recordkeeping violations following a U.S. Department of Labor investigation that identified violations of the Fair Labor Standards Act.
“We are very pleased that these hard-working employees who take care of others are receiving the money they have earned,” said Sandra Sanders, director of the Wage and Hour Division’s district office in Nashville. “The Labor Department is deeply committed to protecting vulnerable low-wage workers, and this action certainly reaffirms that goal.”
Investigators from the Wage and Hour Division found that the company paid employees a daily flat rate that did not yield the applicable federal minimum wage for all hours worked. In addition, some employees were not paid overtime for hours worked in excess of 40 in a week.
To compensate the 17 employees for not receiving the federal minimum wage, the company is paying $54,152 in back wages. Ten of the workers are also sharing $12,542 in overtime back wages.
As part of the agreement, Taylor Brown Gardens Healthcare has created a daily timesheet to track employees’ work hours and has posted required notices to inform employees of their rights.
The FLSA requires that covered employees be paid at least the federal minimum wage of $7.25 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Employers must also maintain accurate time and payroll records.
