LOUISVILLE, Ky. -- Harris Farms Inc. of Carrollton, Ky., has agreed to pay $374,184 in back wages to 417 employees following an investigation by the U.S. Department of Labor’s Wage and Hour Division that found violations of the Fair Labor Standards Act (FLSA).
Investigators determined that the company failed to total all hours worked by employees among its several companies, resulting in employees being paid straight time earnings, despite working more than 40 hours in a workweek. The employer did not include a monthly attendance and production bonus in the employee’s regular rate of pay when computing earnings and failed to keep a record of the total weekly hours worked by employees among its several companies.
Harris Farms employs people to work in several different support activities at the North American Stainless Steel Mill in Ghent, Ky. The company operates under the names Harris Farms, Refractory Services LLC, Carrollton Mill Services LLC and Double H Steel Services LLC.
“The Labor Department is committed to ensuring that employees receive all the wages to which they are legally entitled,” said James Karn, director of the department’s Wage and Hour Division district office in Louisville.
The FLSA requires that covered employees be paid at least the federal minimum wage for all hours worked, and time and one-half their regular rates of pay for hours worked over 40 per week. Hours and wages paid for different jobs held with the same employer must be combined when calculating overtime wages. Employers must also maintain accurate time and payroll records.
