MILLERSVILLE, Md. -- Asplundh Tree Expert Co., doing business as Utility Lines Construction Services Inc. in Millersville, will pay $45,745 in back wages to 41 workers after a U.S. Department of Labor investigation identified violations of the Fair Labor Standards Act.
The investigation, conducted by the department’s Wage and Hour Division, found that employees performing manhole inspections were not paid overtime for hours worked in excess of 40 per week. The company also did not maintain proper records of employee hours.
“Employees were required and directed to pick up and drive company vehicles prior to arriving at a job site and to return them to the company after their shift ended, and were not compensated for those hours,” said John R. Kelly, acting director of the Wage and Hour Division’s Baltimore District Office. “The department is committed to holding employers accountable when they do not comply with the law.”
The FLSA requires that covered employees be paid at least the federal minimum wage as well as one and one-half times their regular rates of pay for hours worked over 40 per week. In general, “hours worked” includes all time an employee must be on duty, or on the employer’s premises or at any other prescribed place of work, from the beginning of the first principal activity of the workday to the end of the last principal work activity of the workday. Additionally, the law requires that accurate records of employees’ wages, hours and other conditions of employment be maintained. The current federal minimum wage for covered, nonexempt employees is $7.25 per hour.
