CLARKSBURG, W.Va. -- The U.S. Department of Labor has filed suit against J.O. Jett Trucking and Jeffrey O. Jett, individually and as corporate president, to recover $59,458 in back wages and fringe benefits due to 21 workers. The Clarksburg trucking company was contracted by the U.S. Postal Service to transport mail.
An investigation conducted by the department’s Wage and Hour Division found the company violated the McNamara-O’Hara Service Contract Act (SCA) when it did not pay employees working as mail haulers the minimum wages and benefits required by the law.
J.O. Jett Trucking was subsequently ordered to pay the amount due by a Labor Department administrative law judge but did not comply. In addition to ordering the payment of back wages, the administrative law judge debarred J.O. Jett Trucking and Jett from receiving future government contracts for a period of three years.
“This action underscores the department’s commitment to diligently protect workers when they do not receive the wages due them,” said John DuMont, district director of the Wage and Hour Division’s Pittsburgh office.
The SCA requires contractors and subcontractors performing services on prime contracts in excess of $2,500 to pay service employees in various classes no less than the wage rates and fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor’s collective bargaining agreement.
The suit was filed in the U.S. District Court for the Northern District of West Virginia by the U.S. Attorney’s Office. Assistant U.S. Attorney Alan McGonigal will serve as local counsel.
