FREDERICKSBURG, Va. -- The Trevin McGregor Group Inc., doing business as Logistics Based Technologies, has paid $179,349 to 54 employees after a U.S. Department of Labor investigation identified violations of the Fair Labor Standards Act (FLSA). The Fredericksburg company manufactures military products for the U.S. Army and Marine Corps.
The investigation, conducted by the department’s Wage and Hour Division district office in Richmond, Va., found that the company paid the employees straight time for hours worked in excess of 40 per week and did not maintain the proper payroll records.
“Logistics Based Technologies employees were not paid the proper overtime premium when they worked more than 40 hours in a workweek,” said Bruce Clark, the Wage and Hour Division’s district director in Richmond. “It is important that employers fully understand their obligations under the law to ensure all employees are compensated properly.”
After the Wage and Hour Division explained the law’s requirement, the company agreed to pay all back wages and comply with all FLSA requirements in the future.
The FLSA requires that covered employees be paid at least the federal minimum wage of $6.55 for all hours worked, plus time and one-half their regular rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. The FLSA provides an exemption from both minimum wage and overtime pay for bona fide executive, administrative, professional and outside sales employees.
