CHICAGO -- The U.S. Department of Labor has recovered $199,464 in back wages for 30 current and former workers of Aaron Auto Glass Inc., a retail auto glass installation and repair shop in Chicago, for violations of the Fair Labor Standards Act.
An investigation by the department’s Wage and Hour Division determined that the company violated the FLSA by failing to pay employees at least the federal minimum wage for all hours worked, requiring employees to work more than 40 hours in many workweeks without properly compensating them for the overtime hours, and failing to maintain proper records of the number of hours worked by employees and the compensation they were paid.
“It is the employer’s responsibility to ensure that all workers are paid properly and in accordance with the law,” said Thomas Gauza, director of the department’s Wage and Hour Division district office in Chicago. “When violations are found, the Labor Department will act swiftly to ensure that workers receive their rightful pay.”
The law requires that covered employees be paid at least the federal minimum wage for all hours worked, plus time and one-half their regular hourly rates of pay, including commissions, bonuses and incentive pay, for hours worked beyond 40 per week. Additionally, the FLSA requires that accurate records of employees’ wages, hours and other conditions of employment be maintained.
