CLEVELAND -- Employees of Marcís in 54 Ohio locations and of Xpect Discounts in six Connecticut locations will receive a total of $426,504 in unpaid overtime wages as directed by a consent judgment after an investigation by the U.S. Department of Laborís Wage and Hour Division determined the company had violated the overtime pay provisions of the Fair Labor Standards Act (FLSA).
ďThe department is committed to ensuring that all workers receive all wages that they are entitled,Ē said George Victory, director of the Wage and Hour Division district office in Columbus, Ohio.
The consent judgment was entered in the federal district court for Cleveland. Both Marcís and Xpect Discounts are retail business names of stores selling groceries, health and beauty items and closeout products operated by Marc Glassman Inc. Cleveland.
The Fair Labor Standards Act requires employees to be paid the federal minimum wage of $7.25 for all hours worked and time and one-half the regular rate of pay for hours worked over 40 in a week unless the employee is exempt from overtime pay. Employers must also maintain accurate time and payroll records.
