Abstract: This program protects and facilitates the smooth and prompt reemployment of members of the uniformed services(to include National Guard and Reserves)following performance of qualifying military service. It encourages individuals to participate in non-career uniform service. The program also prohibits discrimination in employment and acts of reprisal against persons because of their prior military service; current millitary obligations; intent to serve in the uniformed services; filing a USERRA claim; seeking assistance concerning an alleged violation; testifying in a proceeding; or otherwise participating in an investigation.

Purpose: This program assist persons who perform service in the uniformed services to secure employment or prompt reinstatement with their pre-service employers. The program provides information and assistance to protected persons, employers, labor organizations and other elements of a community concerned with employment and reemployment rights of veterans and reserve component members.

Agency Program: Section 4321 of USERRA requires VETS to assist any person with respect to that person's reemployment rights and benefits under the statute. Section 4322 requires the Secretary of Labor to investigate USERRA complaints. Section 4333 requires the Secretary of Labor to inform protected persons and employers of their rights and responibilities under USERRA.
