The U. S. Department of Labor's Pension and Welfare
Benefits Administration has published a new booklet on exemption procedures for
employee benefit plans covered by the Employee Retirement Income Security Act
(ERISA).
The booklet, "Exemption Procedures Under Federal Pension
Law," provides employers, plan administrators and employee benefit
practitioners with the basic requirements and procedures needed to apply for
exemptions from the prohibited transaction rules of ERISA.
It also gives the statutory criteria for granting an
exemption under the law, describes procedures for requesting an exemption from
the department, provides examples of exemption requests and information on
where to get help with exemption application requests.
The department has 20 years of experience processing large
numbers of applications for exemptions from ERISA's prohibited transaction
provisions. The booklet outlines the factors the department ordinarily requires
