Determination of a Complaint Filed under Title IV of the Labor-Management Reporting and Disclosure Act of 1959


On November 28, 2011, the Secretary of Labor received a complaint alleging a violation of Section 401 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), in that no regularly scheduled election of officers has been conducted since 2006, by Our Virgin Islands Labor Union (OVILU) in Christiansted, St. Croix, U.S. Virgin Islands.

Pursuant to Sections 402 and 601 of the LMRDA, the Department of Labor conducted an investigation. The investigation disclosed that the union violated Section 401(b) of the LMRDA by not holding an election of local officers since 2006.

Apprised of this finding, OVILU agreed to conduct nominations, an election, and installation of officers for the executive offices of president, vice president, secretary, and treasurer and for the deputies of the representative council under the supervision of the Secretary of Labor, in accordance with Title IV of the LMRDA. The agreed upon remedial election was concluded on March 22, 2012. It is, therefore,

DETERMINED, that there is probable cause to believe that a violation of Title IV of the LMRDA occurred by the failure of Our Virgin Islands Labor Union (OVILU) to conduct regularly scheduled elections since 2006, but that this violation has been remedied by the new election, conducted in accordance with Title IV of the LMRDA, under the supervision of the Secretary of Labor, on March 22, 2012.

Therefore, civil action under Section 402(b) of the LMRDA based on the November 28, 2011 complaint is not warranted.
