Dear Ms. Johnson:

This is in response to your continuing hardship exemption request for the Communications Workers of America, Local 9333, LM File Number 543-520, for the fiscal year ending September 30, 2006.  Your request dated September 17, 2010 was received by the Office of Labor-Management Standards (OLMS) on September 17, 2010.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

Your union became aware approximately eighteen months ago that several of its Form LM-2 reports are delinquent.  You have been working with the OLMS San Francisco District Office to file all delinquent reports.  Because the process was started eighteen months ago, you were able to download an electronic Form LM-2 for your 2006 fiscal year.  During the data entry process, however, the file was damaged.  You have attempted to have the file repaired but have been advised that it is damaged beyond repair.  You are no longer able to download an electronic Form LM-2 for your 2006 fiscal year, because it is no longer available on the OLMS website.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending September 30, 2006, as you are unable to submit electronically the Form LM-2 report for the 2006 fiscal year.

Enclosed is a paper version of Form LM-2 and instructions.  The report can be completed on the paper form, signed manually, and mailed to OLMS at the address given in the instructions.
