Dear Mr. Stafford:

This is in response to your continuing hardship exemption request for the American Federation of State, County, & Municipal Employees, Milwaukee District Council 48, LM File Number 517-464, for the fiscal year ending December 31, 2009.  Your request dated September 28, 2010 was received by the Office of Labor-Management Standards (OLMS) on October 5, 2010.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You applied for a digital signature in March 2010 but were unable to download the signature.  You mailed a hardcopy Form LM-2 report to OLMS at that time, but received word in August 2010 that OLMS had not received your Form LM-2 report.  You express mailed another hardcopy Form LM-2 report that was received by OLMS on August 18, 2010, and made another attempt to download your digital signature.  However, since you applied for the digital signature the company has upgraded its system and as a result you could not access the digital signature.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2009, due to the difficulties you have encountered in acquiring a digital signature.
