Dear Mr. Hankin:

This is in response to your continuing hardship exemption request for the National Association of Letter Carriers, Branch 3, LM File Number 080-880, for the fiscal year ending December 31, 2009. Your request dated July 15, 2010, was received by the Office of Labor-Management Standards (OLMS) on July 15, 2010. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

On June 12, 2010, you requested an extension of time to file your Form LM-2 report electronically, because you encountered problems with the electronic filing and were awaiting receipt of an electronic signature for your president. You filed a paper copy of your Form LM-2 report with the OLMS Division of Reports, Disclosure, & Audits on April 20, 2010. You were also granted an extension of time to file your Form LM-2 report electronically, until July 15, 2010.

You based your current request upon the following information stated in your letter:

Your president accidentally applied for the wrong type of digital signature, and you were just informed ten days ago that the signature he acquired would not work to file Form LM-2 electronically. He immediately applied for an ACES digital certificate. In order to complete the application process, he needs to verify his address with IdenTrust. Your president recently moved and is awaiting receipt of a utility bill or credit card statement at his new address to forward to IdenTrust as confirmation of his new address. You are therefore requesting a further extension of 60 days to electronically file your Form LM-2 report.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2009, due to the difficulties in obtaining a digital signature for your president, until September 15, 2010.
