Dear Mr. Quintana:

This is in response to your continuing hardship exemption request for the International Association of Machinists and Aerospace Workers, Lodge 933, LM File Number 004-398, for the fiscal year ending December 31, 2009.  Your request dated May 3, 2010 was received by the Office of Labor-Management Standards (OLMS) on June 29, 2010.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

Your local made numerous attempts to submit your LM-2 electronically and assumed it went through and was filed properly.  Upon receiving notification by mail from the OLMS Los Angeles District Office that your report was not received, you attempted once again to file your LM-2 electronically, but were again unsuccessful.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2009, based on the information provided, as you were unsuccessful in your attempts to electronically file the Form LM-2.  Further, you filed a paper copy of your Form LM-2 with OLMS on May 3, 2010.
