Dear Mr. Rauen:

This is in response to your continuing hardship exemption request for the Amalgamated Transit Union, Local 282, LM File Number 050-733, for the fiscal year ending December 31, 2009. Your request dated July 7, 2010 was received by the Office of Labor-Management Standards (OLMS) on July 14, 2010. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

Local 282 was put into trusteeship in February 2010 and all of the officers were removed from office. You appointed an assistant, Matthew Shaw, Sr., to oversee the local while it was in transition. Mr. Shaw was not aware that new electronic signatures needed to be acquired and that the Form LM-2 report should be filed electronically. As of July 2, 2010, you have applied for ACES certificates and you are awaiting receipt of the electronic signatures. Once you receive the electronic signatures, you will file Local 282’s Form LM-2 report electronically. You have filed a paper copy of Local 282’s Form LM-2 report with OLMS.

OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2009, due to your pending application for a digital signature, until August 16, 2010.
