Came the Defendant in person and by counsel, and the Commonwealth by counsel. The Defendant moved the Court to withdraw his former plea of not guilty and to enter a plea of guilty to Theft by Unlawful Taking Over $300. The Court examined the Defendant and counsel, finds Defendant's plea to be voluntary and accepts his plea of guilty.

The Court notes of record the recommendation of the Commonwealth as follows:

Theft by Unlawful Taking Over $300 Two (2) years

Probation in the discretion of the Court and the minimum fine of $l,000. Brady owes restitution of $10,982.15 to United Steelworkers Local 1693. Said restitution is to accrue interest at 12% per annum and is to be paid at a minimum monthly rate of $263.16 ($250.00 to the union, $13.16 to the Circuit Court Clerk's 5% fee). Should the union be paid any money by any bonding or insurance this case shall be decreased by that amount. Fine of $l,000.0 is to be paid at $250.00 per month understands and acknowledges that federal law will bar him from serving in any union position for thirteen (13) years from the date of this conviction and Brady agrees not to seek or hold any union office or position in that time period.

IT IS FURTHER ORDERED:

[X] Pre-sentence Investigation Report be requested

[ ] Defendant remain on same bail

[ ] Defendant be remanded into custody

[X] Defendant shall remain released on his own recognizance pending final sentencing

This matter is assigned to the 12 day of May 2006, at 8:45 a.m. for sentencing.
