A New Day: We’re Listening
On March 3 in Boston, Massachusetts, ODEP and its Federal partners concluded with the final in a series of six disability employment Listening Sessions. Each Listening Session is an opportunity for members of the public to provide input to senior Federal officials on their ideas for more effective ways to employ all people with disabilities, including women, Veterans and minorities with disabilities and what is currently working in their regions to increase employment of people with disabilities. ODEP seeks input particularly from:
- Individuals & Consumers: youth and adults with disabilities, parents and caregivers
- Employers: public and private
- Service Providers & Advocacy Organizations (such as Employment Services and Partners): Independent Living Centers, One-Stops, State Vocational Rehabilitation Programs

January 2010 Disability Employment Statistics Released
In January 2010, the percentage of people with disabilities in the labor force was 21.8 compared with 70.1 for persons with no disability. The unemployment rate for those with disabilities was 15.2 percent, compared with 10.4 percent for persons with no disability, not seasonally adjusted.

Assistant Secretary Kathleen Martinez to Deliver the Keynote Address to Enable America’s Disability Employment Forum on February 3
Employers, community-based organizations, and veterans service providers will assemble to hear from experts on the latest issues and trends in disability employment. In December 2009, the percentage of people with disabilities in the labor force was 21.6 compared with 70.0 for persons with no disability. The unemployment rate for those with disabilities was 13.8 percent, compared with 9.5 percent for persons with no disability, not seasonally adjusted.

DOL’s Office of Federal Contract Compliance Programs Seeks Stakeholder Input on Regulatory Proposals
One of ODEP’s sister agencies, the Office of Federal Contract Compliance Programs (OFCCP) revealed plans to publish a series of proposals that will seek to enhance the agency’s existing regulations and improve compliance with the laws that OFCCP enforces. OFCCP’s mission is to enforce three equal employment opportunity laws: Executive Order 11246, as amended (EO); Section 503 of the Rehabilitation Act of 1973, as amended (503); and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974, as amended, 38 U.S.C. 4212 (VEVRAA).
To help inform the development of these proposals, OFCCP is seeking input from stakeholders via Online Listening Sessions, which are scheduled as follows:
- January 12, 2010, 2:00-3:00PM EST - Affirmative Action & Nondiscrimination Obligations of Contractors and Subcontractors; Evaluation of Recruitment and Placement Results under Section 503 of the Rehabilitation Act. This regulation protects individuals with disabilities from employment discrimination by federal contractors and subcontractors.
- January 14, 2010, 2:00-3:00PM EST - Affirmative Action & Nondiscrimination Obligations of Contractors and Subcontractors; Evaluation of Recruitment and Placement Results under the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). Under VEVRAA, federal contractors and subcontractors are prohibited from discrimination on the basis of veteran status.
- January 20, 2010, 2:00-3:00PM EST - Construction Contractor Affirmative Action Requirements. OFCCP regulations at 41 CFR Part 60-4, require Federal and federally assisted construction contractors to provide equal opportunity in all construction trades.

ODEP Announces Listening Sessions Schedule
Sessions will take place January through March in DOL’s six regional offices
These sessions will focus on gathering input from key stakeholder groups, including consumers, service providers and advocacy organizations, and employers regarding issues critical to increasing employment opportunities and labor market participation for people with disabilities. Participants will be asked to provide comments on:
- More effective ways to increase the employment of women, Vets and minorities with disabilities;
- Identification of Federal and state systems that are effectively collaborating to achieve successful employment outcomes for people with disabilities; and
- The three top issues that the Federal government should focus on to achieve greater labor force participation for people with disabilities.
Agencies invited to participate in the Listening Sessions include the Department of Labor’s Employment and Training Administration (ETA), Veterans' Employment and Training Service (VETS), and Office of Federal Contract Compliance Programs (OFCCP) and Women's Bureau (WB); the Social Security Administration (SSA); the Department of Education (ED); the Office of Personal Management (OPM); and the Department of Health and Human Services (HHS).

DOL Announces Regulatory Agenda That Addresses Employment of Individuals with Disabilities and Disabled Veterans
On December 7, 2009, Secretary of Labor Hilda Solis announced the Department’s Regulatory Agenda. This agenda includes anticipated revisions to the regulations implementing Section 503 of the Rehabilitation Act of 1973, as amended, and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974, as amended (VEVRAA) – both of which are enforced by the Department’s Office of Federal Contract Compliance Programs (OFCCP). These laws require Federal contractors to take affirmative action to employ individuals with disabilities and disabled veterans.

Inclusion in the Green Talent Pipeline
On Wednesday, December 16, Assistant Secretary for Office of Disability Employment Policy (ODEP) Kathy Martinez and Deputy Assistant Secretary for Employment Training Administration (ETA) Gerri Fiala participated in a panel discussion focused on creating strategies for inclusion of people with disabilities in the green talent pipeline. Martinez stressed that "ODEP and ETA will work together to ensure that the workforce development system implements universal design strategies for all providers, thus opening doors to many individuals previously untapped as workers in the green economy."

New Resources Available to Speed Federal Hiring of Individuals with Disabilities
No one delights in the prospect of spending three plus months trying to fill a position, particularly when it takes an average of 102 days to complete all of the steps in the competitive hiring process, from making the request to making the appointment.
No one likes to deal with these built-in barriers when seeking a job in the federal government.
There is a solution.
Over the years, the Office of Personnel Management (OPM) has introduced different hiring authorities to assist in streamlining the hiring process. One such hiring authority is Schedule A, which is an Excepted Service appointing authority which may be used to hire individuals with disabilities.
Using the Schedule A appointing authority, qualified candidates who meet the Office of Personnel Management’s (OPM) guidelines can be hired non-competitively ―
- without the typical recruitment headaches;
- without posting and publicizing the position; and
- without going through the certificate process.
The core of the new Schedule A hiring resource package is a set of quick reference guides that provide Hiring Managers, Disability Program Managers and/or Selective Placement Coordinators, HR professionals, Applicants with Disabilities, and Service Providers with the tools needed to process Schedule A appointments.

Assistant Secretary Martinez to be the Principal Guest Speaker at Disability Policy Forum
On Tuesday, November 17, from 10 AM to noon, Assistant Secretary Kathleen Martinez will be the principal guest speaker for an interactive forum to be held at the Cornell University Government Affairs Office in Washington, DC. The topic is “ODEP Update: New Directions for the Office of Disability Employment Policy at the Department of Labor.” Other panelist/reactors will be Kelly Buckland, E.D. of NCIL; Paul Tobin, President and CEO of United Spinal Association, and Lori Golden of Ernst & Young.
The Disability Policy Forums, sponsored by the Employment Policy RRTC in collaboration with the American Association of People with Disabilities (AAPD), are held quarterly in Washington, DC and are available on the web. Cities Throughout U.S. Declare Disability.gov Day During National Disability Employment Awareness Month
In conjunction with National Disability Employment Awareness Month, Assistant Secretary Martinez asked mayors from cities, recognized for their accessibility and contributions to the disability community, to declare a day in October as Disability.gov Day. The Department of Labor and the Office of Disability Employment Policy extend their thanks and appreciation to all the cities that participated. US Department of Labor Announces Web-based Collaborative Policy-Making Initiative to Address Disability Employment Barriers
ePolicyWorks is a collaborative, information-sharing initiative among national policymakers designed to address specific barriers to employment faced by people with disabilities. The goals of ePolicyWorks closely align with the guiding principles outlined in the President’s disability agenda – from strengthening access to and improving the quality of health care, to protecting civil rights and increasing opportunities for employment. Facilitating real-time coordination and communication, ePolicyWorks is an unprecedented effort to tackle today’s critical disability employment issues.

Stars Focus on Ability
On Thursday, October 22, Secretary of Labor Hilda Solis convened a panel to discuss and answer audience questions about people with disabilities in the performing and visual arts. Before a standing room only audience in the DOL auditorium, Secretary Solis was joined by Assistant Secretary for Disability Employment Policy Kathleen Martinez, performance artist Fred Beam, and actor Robert David Hall, who portrays Dr. Al Robins on the popular TV show "CSI: Crime Scene Investigation."

Three Issue Briefs from the ODEP-funded National Technical Assistance and Research (NTAR) Leadership Center are now available.
- Issue Brief No. 1: Entrepreneurship for Veterans with Disabilities: Lessons Learned from the Field examines entrepreneurship as a viable option for veterans with disabilities, particularly those returning from the present-day Middle East conflicts. This brief examines the Entrepreneurship Bootcamp (EBV) introduced at Syracuse University's Walt Whitman School of Management.
- Issue Brief No. 2: Leveraging State Economic Development Resources to Create Job Opportunities for People with Disabilities highlights existing state regional, and local economic development resource tools and discusses ways in which states and localities can leverage traditional loan and financing programs that enhance job creation, provide access to local employment opportunities, or help support employment for residents, with and without disabilities.
- Issue Brief No. 3: Collaborating and Coordinating with Employers examines the evolving relationship between disability employment initiatives and employers, and uses case illustrations of selected collaborations to demonstrate these characteristics, including implications for effectively formulating broad-scale promotion of disability workforce investment initiatives.
The NTAR Leadership Center is a collaboration of partners with expertise in workforce development, disability employment, economic development, financial education, benefits planning, and leadership development. Established in September 2007 through a grant from ODEP, the Center is housed at the John J. Heldrich Center for Workforce Development at Rutgers, The State University of New Jersey.

Maryland Governor's Workforce Investment Board (WIB) Submits Universal Design Resolution
In September 2009, the Maryland Governor's WIB submitted a Resolution that stated, "in order to assure that there truly are no spare Marylanders, all of Maryland's potential workers should be provided with universal access, services and processes according to the principles known as Universal Design." This Resolution is a priority of the Maryland pilot under the coordination of the ODEP-funded National Technical Assistance and Research (NTAR) Leadership Center's State Leaders' Innovation Institute (SLII). In 2008, Maryland, Connecticut, and Minnesota were selected to participate in the first SLII, part of a national effort to improve employment for adults with disabilities with a particular focus on Universal Design. Labor Day Message from Assistant Secretary Kathleen Martinez
Each year on Labor Day we celebrate the achievements of America's workers. In many ways, it's a unique holiday, commemorating not just one person or historical event, but rather the collective capacity of workers. It honors the ingenuity and innovation that characterize the American spirit.
Labor Day emerged from the grassroots. The first observances were held at the local level. The idea quickly gained traction at the state level, and in 1894 Congress established the nationwide, annual holiday we know today. Clearly, the way we work has changed since then. But the premise behind the holiday has not.
The foundation that underpins the industriousness of our nation's workers is America's promise of equal opportunity for all. And since the first Labor Day, more and more people from all walks of life have realized this promise. Today, our nation benefits from an increasingly diverse workforce, one that offers a number of different perspectives and rich ideas to American businesses of all sizes and in all industries.
An important dimension of this diversity is disability. Every day, people with disabilities make significant contributions to workplaces across the U.S. Yet, in both good economic times and bad, people with disabilities have fewer opportunities than those without disabilities—a reality that stands in stark contrast to America's ideals.
America's future success requires us to capitalize on the talents of all segments of the population, and the responsibility is shared. Employers must foster workplaces welcoming to all qualified employees and potential employees. People with disabilities must understand the intrinsic value of work and their role in our economic success. Youth with disabilities must grow up with the expectation of employment, and parents, educators and other adults must strengthen this expectation by cultivating a clear vision of work and community participation.
Advancing employment opportunities and expectations for people with disabilities strengthens not only America's economy, but our moral fiber. It creates a more inclusive America, one where every person is recognized for his or her accomplishments—and that should be our goal not just on Labor Day but every day.

Solicitation for Grant Applications - National Technical Assistance, Policy, and Research Center for Employers on Employment of People with Disabilities.
The U.S. Department of Labor’s Office of Disability Employment Policy announces the availability of up to $1.6 million to fund a National Technical Assistance, Policy, and Research Center for Employers on the Employment of People with Disabilities. Under this cooperative agreement, the Center will conduct research, assist in the development and promotion of employer-focused policy, disseminate information, and provide technical assistance to a wide range of employers and employer organizations on the recruitment, hiring, retention, and advancement of people with disabilities. There will be an initial 12-month period of performance, and the possibility of up to four additional option years of funding at the discretion of the Department depending on the availability of funds and satisfactory performance.
To be considered for an award, the consortium applying for the grant must have representation from a public/private non-profit or for-profit organization, an educational institution, and a national organization serving a network of employers or employer organizations with demonstrated experience in facilitating a business to business dialogue with employers on the business case for employing people with disabilities.
Applications must be received by 5:00 PM Eastern Time, September 10, 2009.

Kathleen Martinez Confirmed as Assistant Secretary for Disability Employment Policy
On June 25, 2009, the Senate voted by unanimous consent to confirm Kathleen (Kathy) Martinez as Assistant Secretary for the Office of Disability Employment Policy. Blind since birth, Ms. Martinez comes to ODEP with a background as an internationally recognized disability rights leader specializing in employment, asset building, independent living, international development, diversity and gender issues.

Solicitation for Grant Applications - Registered Apprenticeship for Youth and Young Adults with Disabilities
The U.S. Department of Labor’s Office of Disability Employment Policy and Employment and Training Administration’s Office of Apprenticeship announce the availability of approximately $400,000 to fund two Registered Apprenticeship for Youth and Young Adults with Disabilities cooperative agreements. Under this initiative, the grantees will conduct two pilot projects to develop models to improve systems capacity to provide inclusive Registered Apprenticeship training and pre-apprenticeship training to youth and young adults with disabilities ages 16 to 27 utilizing the increased flexibilities detailed in DOL’s newly released apprenticeship regulations. There will be an initial 24-month period of performance, and the possibility of up to three additional option years of funding at the discretion of the Department depending on the availability of funds and satisfactory performance.
To be considered for an award, the consortium applying for the grant must, at a minimum, have representation from each of the following four organization types:
- A Registered Apprenticeship Program sponsor in a high-growth industry sector;
- A community-based organization with demonstrated experience securing job training services from established training institutions such as community colleges, and providing placement and support services to apprentices in high-growth industries;
- A public/private non-profit or for-profit organization, which may be faith-based, with demonstrated experience providing employment and training services and employment related support services to people with disabilities; and
- An educational institution.
The overarching goal for this solicitation is to increase systems capacity to provide integrated inclusive apprenticeship training to youth and young adults with a full range of disabilities, including those with the most significant disabilities, utilizing the increased flexibilities detailed in DOL’s newly released apprenticeship regulations.

JAN introduces the What Can YOU Do? Video Contest
The What Can YOU Do? Video Contest is an opportunity for young - and young-at-heart - filmmakers to promote positive change by illustrating that at work, it’s what people CAN do that matters. The contest is sponsored by the Campaign for Disability Employment, a collaborative effort between the American Association of People with Disabilities (AAPD); the National Business and Disability Council (NBDC); Special Olympics (SO); the U.S. Business Leadership Network (USBLN); and the Job Accommodation Network (JAN). It is funded under a contract from the Office of Disability Employment Policy.

ODEP Releases Roadmaps II for Enhancing Employment of Persons with Disabilities Through Accessible Technology
Roadmaps II is a report that looks at the issue of AT and employment from the perspective of AT service providers and disability stakeholders who work directly to assist individuals with disabilities. Roadmaps II is a result of the work of the AT Collaborative – a group of national organizations funded by ODEP and CESSI to address AT issues and provide policy recommendations related to the employment of individuals with disabilities. Roadmaps II follows the January 2008 release of Roadmaps I, which is a report on the consensus Roadmaps developed by participants in the 2007 Business Dialogue on Accessible Technology and Disability Employment for how best to enhance the hiring, retention, and advancement of persons with disabilities and others through accessible technology.

Just Released: Database of More Than 1,900 Job Candidates with Disabilities
The U.S. Department of Labor released to employers nationwide a free database of more than 1,900 pre-screened college students with disabilities who are seeking summer and regular employment opportunities. Candidates in this database are pursuing degrees in fields ranging from math and business to IT and law.
“Historically, people with disabilities consistently have experienced difficulties finding employment regardless of the economic climate,” said Secretary of Labor Hilda L. Solis. “Providing an internship or first job to someone with a disability can provide a real jumpstart in launching a successful career. The Workforce Recruitment Program offers top talent while enabling college students and recent graduates the opportunity to gain invaluable work experience.”
Federal employers can tap into this ongoing recruitment resource online through the Workforce Recruitment Program, and private sector, other government and nonprofit employers can request unlimited searches by calling the Labor Department's Employer Assistance and Resource Network at 866-327-6669.

First Official Disability Employment Statistics Released
Today, the U.S. Department of Labor released the first official data on the employment status of persons with disabilities. In January 2009, the employment rate for persons with disabilities was 20 percent. The unemployment rate for those with disabilities was 13.2 percent.
These data provide, for the first time, an official monthly measure of the labor force situation for people with disabilities. The Department of Labor's Office of Disability Employment Policy (ODEP) sponsored the addition of new disability questions to the Current Population Survey (CPS) starting in June 2008. The addition of these questions to the CPS will allow the analysis of the labor force situation of persons with disabilities to be based on the same concepts that are already used for other groups. In addition to using the data to formulate policy recommendations, ODEP will use them to target its training, technical assistance, research, and dissemination efforts.

ODEP's Customized Employment Initiative Receives 2009 Harvard Innovations in American Government Awards Recognition
Harvard University's Ash Institute for Democratic Governance and Innovation recognizes ODEP's Customized Employment initiative as noteworthy, placing it among the top 20 percent of more than 600 applicants. The Committee for Purchase From People Who Are Blind or Severely Disabled recently launched a landmark initiative to enhance quality work environments for more than 40,000 Americans employed through AbilityOne, a program that provides employment through the federal procurement process to people who are blind or have other severe disabilities.
Formally ratified by all members on January 8, 2009, the Policy on Best Practices for a Quality Work Environment was spearheaded by the Committee’s Subcommittee on Communications and Customer Satisfaction, chaired by Assistant Secretary of Labor for Disability Employment Policy. To develop it, the Assistant Secretary of Labor and Subcommittee members James Omvig and Kathleen James collaborated closely with the Committee’s Chairperson, Andrew Houghton, and its two central nonprofit agencies, National Industries for the Blind (NIB) and NISH (for people with severe disabilities).
At the core of the policy initiative are three guiding principles reflective of AbilityOne’s vision, which is to enable all people who are blind or have other severe disabilities to achieve their maximum employment potential. These principles—which broadly state that AbilityOne workers should be provided competitive wages, a clear career path and ongoing training—will now serve as a framework for the development of best practice standards for the more than 600 nonprofit agencies across the nation that participate in the AbilityOne Program. As part of this process, NIB and NISH will begin to identify and create best practices, and assist their associated nonprofit agencies in development of Quality Work Environment Business Plans that reflect the principles and include a self-certification program based on them.
In voting to approve the recommendations set forth in the Policy on Best Practices for a Quality Work Environment, Committee members have embarked on a significant new course for the AbilityOne Program, one that further advances America’s promise of equal opportunity for all citizens, including those with disabilities.

Ground-Breaking Survey of Employer Actions/Attitudes Released
The Survey of Employer Perspectives on the Employment of People with Disabilities is the first of its magnitude, with responses representing more than 2.4 Million companies nationwide. The survey reveals that a majority of large businesses hiring people with disabilities are discovering that costs for accommodations differ very little from those of the general employee population. Additionally, the survey showed that once an employer hires someone with a disability, they are much more likely to hire other people with disabilities.

Job Accommodation Network Offers ADA Amendments Act of 2008 Resources
The ADA Amendments Act of 2008 became effective on January 1, 2009. Although the Equal Employment Opportunity Commission (EEOC) has not yet completed the regulations for the new legislation, ODEP’s Job Accommodation Network (JAN) has developed both a publication and a resource page regarding the Act.
The new publication is JAN's Accommodation and Compliance Series: The ADA Amendments Act of 2008 (http://www.jan.wvu.edu/bulletins/adaaa1.htm) and will be periodically updated as additional information is made public.

On December 9, 2008, the Assistant Secretary joined UCLA Anderson School of Management Dean Judy Olian and Executive Education Assistant Dean Kelly Bean to sign ODEP’s most recent Alliance. Witnessing the signing were representatives of several of the founding sponsors of UCLA Anderson’s Leadership Institute for Managers with Disabilities.
ODEP’s Alliance Initiative is a cooperative program that enables organizations committed to improving disability workplace practices to work with ODEP to develop and implement model policies, initiatives and strategies that increase recruiting, hiring, advancing, and retaining workers with disabilities.
During opening remarks, the Assistant Secretary noted that by providing jobs, business provides social change in the lives of people with disabilities. Recognizing that the UCLA Anderson School of Management is perennially ranked among the top-tier business schools in the world, the Assistant Secretary lauded the Executive Education Program for preparing the business community to offer careers that enable people with disabilities to progress from the mailroom to the boardroom.
Dean Judy Olian offered that UCLA Anderson, unlike most of the other top business schools, is a public school with a public mission. The school’s belief in the value of partnerships is exemplified by this Alliance, which takes on a special meaning in preparing global leaders to influence management thinking throughout the world.
Immediately following the ceremony, Assistant Dean Kelly Bean opened a forum during which the Alliance ceremony guests engaged in a conversation with Assistant Secretary Romano. The discussion focused on effective practices and workplace challenges with internships, centralized accommodation budgets, and accessible technology cited as important policy areas. Companies and organizations represented at the event were IBM, PepsiCo, Microsoft, AT&T, Qualcomm, California State University Northridge (CSUN), the CSU Chancellor’s Office, SunTrust & the USBLN.
The Assistant Secretary closed the event addressing innovation, which is at the core of ODEP’s Alliance Initiative. But most importantly, he stated his belief that people with disabilities will create the next great wave of innovation, providing the world with the industrial revolution of tomorrow.

On July 10, 2008, DOL’s Office of Federal Contract Compliance Programs (OFCCP) issued a Directive [PDF] [HTML]outlining federal contractors’ obligation to ensure equal employment opportunity for individuals with disabilities and disabled veterans when they use an online application system. This obligation includes providing necessary reasonable accommodation when requested by an individual or veteran with a disability, unless doing so would cause an undue hardship. The Directive was accompanied by valuable sets of Frequently Asked Questions (FAQs) directed at both employers and employees [PDF]. ODEP's National Technical Assistance and Research (NTAR) Leadership Center to promote employment and economic independence for adults with disabilities has selected three states--Connecticut, Maryland, and Minnesota--to participate in its first State Leaders' Innovation Institute. The State Leaders' Innovation Institute is part of NTAR's national efforts to improve employment for adults with disabilities by connecting state workforce policies to state and local economic growth and development goals.

The Digest, a companion to BPWF's June 2008 National Employer Summit, will showcase promising practices, great ideas, and applied research that builds diverse, equitable, and flexible workplaces. Submissions were contributed by a diverse pool of employers, researchers, and advocates.
