Reclassification of Functions in the DOL 2005 Inventories of Commercial and Inherently Governmental Activities

Reclassifications Pursuant to Occupational Safety and Health Administration (OSHA) Whistleblower Program Challenge Determination

  1. Occupational Safety and Health Administration (OSHA) function code I999 has changed 3 FTE from Commercial Reason Code A to Inherently Governmental and 67 FTE from Commercial Reason Code B to Inherently Governmental.

Initial Determinations Reclassifications

  1. Mine Safety and Health Administration (MSHA) function code C301 has changed 6 FTE from Inherently Governmental to Commercial Reason Code B.
  2. Mine Safety and Health Administration (MSHA) function code C403 has changed 1 FTE from Inherently Governmental to Commercial Reason Code B.
  3. Office of the Assistant Secretary for Policy (OASP) function code T820 has changed 4 FTE from Commercial Reason Code A to Commercial Reason Code B.

Challenges to Initial Determinations Reclassifications of the 2005 FAIR Act Inventory

The FAIR Act permits an interested party to challenge the inclusion or exclusion of an activity from DOL’s FAIR Act Inventory. Since DOL has made Initial Determinations reclassifications to the 2005 FAIR Act inventory, those changes may be challenged (Note: only the functions listed under 2-4 above maybe challenged at this time).  Under OMB Circular A-76, the application of reason codes may be challenged. Challenges must be filed within 30 working days of the publication of the Federal Register notice that DOL’s FAIR Act Inventory was available. The last day for receipt of challenges for the changes to DOL’s 2005 Inventory is August 21, 2006.
