Title: Use of or Impairment From Alcohol and Other Drugs on Mine Property 

Abstract: MSHA published a proposed rule to address the risks and hazards to miner safety from the use of or impairment from alcohol and drugs on mine property. At this time MSHA is withdrawing action on this rulemaking. Reason for Withdrawal: Due to comments, and limited data on the effects of alcohol and drug use related to mine accidents, MSHA is withdrawing the proposed rule. Many commenters raised concerns that the proposed rule would negatively impact existing alcohol and drug programs at mining operations, thereby possibly resulting in a diminution of safety. Although MSHA is withdrawing the proposed rule, the Agency will continue to enforce the existing metal and nonmetal standard. In addition, MSHA will collect data to determine the extent to which the use of alcohol or drugs contributes to mine accidents, and will continue to consider options available to the Agency to address alcohol and drugs at all mines.
