Abstract: The implementation of diesel regulations in 30 CFR parts 7, 36, 57, 72, and 75 has resulted in an increase in requests from owners of approved equipment, typically underground mine operators, to field modify permissible diesel-powered equipment. Field modifications allow permissible equipment to be modified for mine-specific use or to comply with new diesel standards. Therefore, the Mine Safety and Health Administration is proposing to add field modification provisions to 30 CFR part 36 (Approval Requirements for Permissible Mobile Diesel-Powered Transportation Equipment).
This proposed rule would codify the field modification process for part 36 field modification acceptances, expand the field modification process to allow mine operators to apply for field modifications, and continue to ensure that field-modified equipment operates safely in gassy underground mines. The proposed rule would also implement existing policy which dates from 1985, to reflect current procedures for processing field modifications related to mobile diesel-powered transportation equipment. Further, the proposed rule would require labeling provisions for all new field modifications accepted under part 36. These new provisions would enhance miner safety.
