The Grand Jury charges:

Count 1

     1. At all times material to this Indictment, the Brotherhood of Locomotive Engineers, Division 402 of Pasco, Washington, was a labor organization engaged in an industry affecting commerce within the meaning of Section 402(j) of Title 29, United States Code.

     2. That from on or about July 11, 2001, through and including on or about July 25, 2003, in the Eastern District of Washington, the defendant, KIMBERLY SOLHEIM, did willfully make and cause to be made false entries in a record required to be kept by Section 436 of Title 29, United States Code, that is, accounts payable journals and books.

     All in violation of Title 29, United States Code, Section 439(c).

Count 2

From on or about July 11, 2001, through and including on or about July 25, 2003, in the Eastern District of Washington, the defendant, KIMBERLY SOLHEIM, a person employed, directly and indirectly, by the Brotherhood of Locomotive Engineers, Division 402, located at Pasco, Washington, a labor organization engaged in an industry affecting commerce, did embezzle, steal and unlawfully and willfully convert to her own use and the use of another the moneys and funds of said labor organization in the approximate amount of $14,635.00.

All in violation of Title 29, United States Code, Section 501 (C).
