     The Grand Jury charges that:

COUNT 1

     That between on or March 16, 2000 to September 10, 2001, in the Southern District of Ohio, the defendant, TIMOTHY C. BURKE, while the business manager/financial secretary for Roofers Local 42, a labor organization engaged in an industry affecting commerce, did embezzle, steal and unlawfully and willfully abstract and convert to his own use the moneys, funds, securities, property, and other assets of said labor organization in the approximate amount of $31,570.64.

     In violation of 29 U.S.C. § 501(c).
