The United States Attorney charges:

 

           COUNT ONE

 

On or about June 30, 1998, In the Middle District of Florida,

  HOWARD ROUNDTREE,

defendant herein, did knowingly cause to be made false statements and representations of facts, knowing them to be false, in a document required by title I of the Employee Retirement Income Security Act of 1974 (as amended from time to time) to be published, and kept as part of the records of any employee welfare benefit plan and employee pension benefit plan, and certified to the administrator of any such plan, that is, false statements and representations of facts regarding payroll hours, reported in the monthly remittance form submitted by Federal Marine Terminals, Inc. for the administration of the Tampa Banana Handlers Welfare and Pension Plans.

In violation of Title 18, United States Code, Sections 1027 and 2.
