What happens to an employee’s health insurance when employment is terminated?

The Fair Labor Standards Act (FLSA) does not have jurisdiction over matters such as health insurance. The Employee Benefits Security Administration (EBSA), which administers both the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) and the Health Insurance Portability and Accountability Act of 1996 (HIPAA), can offer guidance related to insurance benefits.
