____________

In the Matter of GILBERT T. HOLLE and DEPARTMENT OF VETERANS AFFAIRS,

VETERANS ADMINISTRATION MEDICAL CENTER, Baltimore, MD

Docket No. 00-849; Submitted on the Record;

Issued June 22, 2001

____________

DECISION and ORDER

Before   WILLIE T.C. THOMAS, A. PETER KANJORSKI,

PRISCILLA ANNE SCHWAB

            The issues are:  (1) whether the Office of Workers’ Compensation Programs properly determined that appellant received an overpayment in the amount of $2,043.55; and (2) whether the Office properly denied waiver of the overpayment.

            The Board has given careful consideration to the issues involved, the contentions of the parties on appeal and the entire case record.  The Board finds that the October 10, 1999 decision of the hearing representative of the Office is in accordance with the facts and the law in this case and hereby adopts the findings and conclusions of the Office hearing representative.

            The October 10, 1999 decision of the Office of Workers’ Compensation Programs is hereby affirmed.[1]
