Employees’ Compensation Appeals Board

____________

In the Matter of SHERYL L. GIFFORD and U.S. POSTAL SERVICE,

POST OFFICE, Santa Barbara, CA

Docket No. 00-1057; Submitted on the Record;

Issued July 19, 2001

____________

DECISION and ORDER

Before   DAVID S. GERSON, BRADLEY T. KNOTT,

A. PETER KANJORSKI

            The issue is whether appellant had any further disability or injury residuals after May 19, 1999, causally related to her June 21, 1991 right shoulder impingement syndrome.

            This is appellant’s second appeal before the Board.  In the prior appeal, by decision dated March 29, 1995, the Board affirmed that appellant was not entitled to wage-loss compensation after March 30, 1992.[1]  The facts and circumstances of the case are thoroughly recounted in the prior Board decision and are hereby incorporated by reference.

            The Board has given careful consideration to the issue involved, the contentions of the parties on appeal and the entire case record.  The Board finds that the decision of the Office of Workers’ Compensation Programs’ hearing representative dated October 14, 1999 is in accordance with the facts and the law in this case and hereby adopts the findings and conclusions of the hearing representative.

            The decisions of the Office of Workers’ Compensation Programs dated October 14 and May 19, 1999 are hereby affirmed.
