Department of Labor files complaint to remove fiduciaries of
Polaris America LLC 401(k) Profit Sharing Plan in Columbus, Ohio

Names of Defendant:  Polaris America LLC; Christopher Filos; and the Polaris America LLC 401(k) Profit Sharing Plan located in Columbus, Ohio

Allegations:  As fiduciaries of the Plan, defendants Polaris America LLC and Christopher Filos failed to administer the Plan and participants have not been able to obtain distributions of their individual accounts since November 2011.

The plan had three participants and assets totaling $16,072.37 as of June 18, 2013.

Resolution: The Department of Labor is asking the court to remove the defendants, Polaris America LLC and Christopher Filos, as fiduciaries and appoint an independent fiduciary to effectuate the termination of the Plan and distribution of participant’s individual accounts.
