Subject: United States Department of Labor Compliance Assistance Updates - FMLA, VETS-100, USERRA
Family and Medical Leave Act (FMLA)
The Department of Labor's Wage and Hour Division published a Final Rule under the Family and Medical Leave Act. The Final Rule becomes effective on January 16, 2009, and updates the FMLA regulations to implement new military family leave entitlements enacted under the National Defense Authorization Act for FY 2008. It also includes revisions in response to public comments received on the proposed rule issued in February 2008. VETS-100
The Labor Department's Veterans Employment and Training Service (VETS) issued a Final Rule revising the regulations requiring federal contractors to report annually on the number of their employees who are veterans. The Final Rule implements the Veterans' Benefit and Health Care Improvement Act of 2000 amendments that extended to “recently separated veterans” the protections contained in the Vietnam Era Veterans' Readjustment Assistance Act of 1974. Recently separated veterans are defined as veterans who left active military duty within the past three years.
The Final Rule also clarifies that the requirements in 41 C.F.R. Part 61-250 apply to government contracts entered into before December 1, 2003, and that the requirements in 41 C.F.R. Part 61-300 apply if a contract entered into before December 1, 2003, is modified on or after that date, and as modified, is worth at least $100,000. The rule requires that the data be reported on the VETS-100 Report. Employers may submit the Report electronically or via paper copy.
Uniformed Services Employment and Reemployment Rights Act (USERRA)
VETS has also revised the notice “Your Rights Under USERRA.” The notice is for use by Federal agency, private and State employers. Employers, however, may continue to utilize the former USERRA notices dated January 2006.
