EXECUTIVE SUMMARY REPORT

INTRODUCTION TO THE PIA

Purpose

The purpose of this document is to evaluate and certify that Department of Labor, Wage & Hour Division's (WHD) Wage & Hour Investigative Support and Reporting Database (WHISARD) meet or comply with privacy policies when operating to service the user base.

Scope

This Privacy Impact Assessment (PIA) covers the Employment Standards Administration's Wage & Hour Investigative Support and Reporting Database (WHISARD), which is managed by the Wage Hour Division (WHD). The WHD Administrator is the system owner.

Results

Based on the Privacy Impact Assessment Questionnaire, WHD states that WHISARD, the automated system, is fully compliant with Privacy Act of 1974. The WFAS meets all requirements of the Privacy Act listed under 5 U.S.C. 552a.(4) as amended, listed under "Records Maintained On Individuals."

Summary

Information is collected by WHD to enforce federal laws and to benefit individuals. WHD protects an individual's rights to privacy through their automated system. WDS supports the Privacy Act, 5 U.S.C. 552a, and OMB Circular No. A-130, "Management of Federal Information Resources," 61 Fed. Reg. 6428 (Feb. 20, 1996).

WHD has performed the threat analysis as described in Section 1.4. WHD has adequate controls in place to protect individuals and the DOL. There are no adverse impacts on WHISARD due to PIA results. The detailed Privacy Impact Assessment Questionnaire in Section 2 provides details to substantiate WHD findings.
